This figure, determined by California’s child support formula, is presumed to be accurate unless proven otherwise. However, when one parent’s income reaches astronomical levels, the standard formula may not fit the bill.
For exceptionally high earners, like those bringing in tens of millions annually, the basic guideline may not adequately cover a child’s needs. In such cases, the formula’s presumption can be challenged. If a parent’s income is so high that the formula results in an amount that surpasses the child’s genuine needs, adjustments may be warranted. The courts recognize that the child of a wealthy individual may require more than the basic necessities to maintain their accustomed lifestyle.
To deviate from the guideline amount, the parent paying child support must demonstrate that the standard formula would be unjust or inappropriate. They need to prove that any proposed reduction is in the child’s best interest. Additionally, when high-income earners are involved, detailed financial disclosures can become a point of contention. If a dispute arises regarding the appropriate child support amount, the court will need ample information to assess the child’s needs. This includes scrutinizing the supporting parent's income.
